Hi there, I hope someone can help/advise me. I completed a short sale on my property on 03/25/11. The Bank of America short sale close emailed my broker to confirm the funds had been received, sale completed and case closed. The BOA short sale web-site also shows a closed status. Per the country assessor's web-site, the deed has been transferred to the new owner. However, I can not get the country to stop the foreclosure auction that had been scheduled for May. The county referred me to BOA foreclosure attorney. His office stated they need to receive notice from BOA. BOA referred me to BAC (their servicer). I have spent hours on hold w/ various indivuduals from the East Coast to Texas to Chicago (and according to the sound of some of their accents, the world). Supposedly it is in their litigation department (I never hired an attorney for me case) and they can't tell me why. I've had people promise to call me back and did not follow thru. Please help, I am sooo stressed about this. Aside from my personal interest, it would be horrible if they evicted the new owner !

This is a pretty cold-hearted answer but isn't this not your problem anymore? You sold/closed on the property so the new owner is the one who should be spending the hours on the phone to clear this up...if you've closed and sold then Bank of America has released you from your debt and you have no responsibility for it and the property anymore.

I've heard bad things about Bank of America just from my research on the internet, so you are probably not alone in your problems.

Sorry I'm not more help with this reply. I've made an offer on a short sale property so I do take an interest in this issue so it doesn't happen to me as the buyer. How long did it take from when you accepted the offer to when BOA accepted it? Did they come back to the buyer and ask for more $? These are just questions for my own curiosity. Thankfully I don't thik BOA is involved in the property I made an offer on.

If you send proof of the short sale approval to the foreclosing attorney's office along with the signed HUD1, the NED will be withdrawn.

You can look up the attorney's information from the public trustee's website.

I'm on these forums accross the web a good bit and always see the same frustrations and questions about being denied in the loan modification process. It's such a time consuming process to get on these forums, ask questions, and then hopefully one of the answers is the magic bullet.

I wanted to stop the foreclosure process as I was about to lose my home so I tried to get a loan modification. Well after months of waiting for an answer, the lender I was using (BOA) ended up denying my application. After this I had no idea how to stop the foreclosure from happening, probably like a lot of you. I read and read these forums for the answer and none of it helped with my situation.I was about to just let my house go and give up completely. Well I ended up finding a good solid company through the YellowPages online website so if any of you are looking for help, that's a good place to start. At the end of the day I was able to find Stop Forclosure Defense Attorneys to help me out and at least now the foreclosure process has been stopped and we're in the process of finalizing the loan modification.

Try the CO foreclosure hotline Colorado Foreclosure Hotline > Home or your local housing counseling agency.

There is a HB 1276 that might help. Colorado Division of Housing: House Bill 1276 and the Foreclosure Deferment program

There is also a short sale, a deed in lieu of foreclosure and other loan mod programs.

BOA will probably wait until the last minute before they update their documentation. Don't let them stress you about it. They can't sell something that isn't theirs to sell.

That's not the OP's responsibility. Why make their job easier for them? I say do nothing and let BOA squirm when they try to foreclose on something they've already sold to somebody else!

Oh, they like to foreclose illegally. The AG's office can't handle the volume.

Even after they have have accepted a wire payoff.

Which of those statements would you like proof of?

Every Realtor in town that deals with distressed owners/properties have dozens of examples.
