Hi all,
Today there was slippery ice in one of Aurora’s small streets. My car started skidding and I lost control and hit a Power pole and there was a very minor damage to it. The street was empty. I called the police and they told me that I have to appear in the court. I’m new to the country and I have a clear record for 5 years which is the period I have been living in the US. My question is am I going to go to jail for that? Thanks

No, but if you're worried about it consult with an attorney.

Most of the time the city will make you pay to replace poles even with "minor" damage. They fear something unseen in that minor damage will cause liability issues in the future.

Get ready for a big bill if that is the case. Hopefully your car insurance will pay for it.

I would even fight a “careless” charge. To me that term is offensive.

I had a buddy of mine hit a light pole, very minimal damage. Needless to say, he had to pay to have it replaced...in the ball park of $1500

Always plead not guilty to the first charge.

What is the specific statute/ordinance number on the ticket?

It's an Aurora policy that if police have to show up for an accident they have to give a ticket for careless driving at a minimum. Ask any insurance agent about how annoying this policy is because that particular charge reads pretty badly in the insurance points system. They may not say it, but the police really don't want to use resources on attending to accidents with only minor damage and no injuries so they follow this policy to essentially discourage you from doing it.
