yes, I can agree here - the waitress may have an advantage in looks here which allows her to earn more.
but that still doesn't cover for how the employer should be able to pay less.
why should the owner get away with this, and effectively rely on the customer to make his staff's wage up to the minimum?
I agree the employer should not pay less but there are limits to it and he does not rely on customers to make up to the minium.
He must pay at least $2.13 an hour period and all tips after that could potenially be hers. She can not bring home pay less than $7.25 an hour. He can only take $5.12 an hour max of the tips, she keeps the rest.
the problem with tip sharing is tax implications. nothing is a problem until its a problem.
we have a friend who is a waiter. they were audited when the place he worked for was audited.
the irs has a computation they use that projects what your tips should have been . the fact you had to give a portion of your tip money to the busboys, the cook , etc doesnt count. the irs says they owe 10k in taxes on tips and he had to 1099 everyone he had to split with if he didnt want to have to be held accountable for it all.
so now they are stuck having to pay taxes on an implied amount and they never even got the money.
waiters have to keep records far beyond what anyone does or when the day comes they are audited your screwed. i dont know one waiter who 1099's anyone who they have to split with .

That does seem a little absurd. But I'm not surprised... they had recently passed a law that would require me to 1099 the person who shines me shoes and cleans my clothes. Fortunately it was later repealed.

yes, but the whole business must work as a team otherwise it falls apart.
Take away the ugly waitresses, plate cleaners, veg choppers etc and the place cannot function.
These staff allow the hot waitress to make the tips - so they should be shared equally amongst all the staff.
sharing equally is absurd it takes away almost all motivation for anyone to do their jobs well
ok maybe the ugly waitress cant make as much as the hot one but if she still does a good job she will make more money than if she does a bad one

the worst dealers in this country are in foxwoods
they are one of a few (or possibly the only) group of poker dealers to pool their tips in the country so almost nobody cares about doing a good job
if I went to a resteraunt and got a good waiter but knew he had to pool his tips with all the crappy waiters tips I would give him a lot less than I would than if I knew he got to keep his own tips. I tip very well for good service but Im not going to give hand outs either.I would rather any bad waiter I have ever had to get no tips so they need to find a new job than for people to mindlessly give them money so I get stuck with them again.
When tips are pooled it benefits bad workers and punishes good ones
if someone works in a place with 5-10 waiters, plus bus boys cooks etc and tips are pooled equally they all have very little reason to try to do a good job
starbucks and dd cant get away with paying their employees 2 bucks an hr
But they took away those tips you left your server until the courts stepped in.
