Obviously the meeting created many questions and much concern. We are committed in carefully working through and resolve all issues identified as it is our interest to create a cohesive community relationship. Your comments/suggestions/questions, which I’ve responded to below, align with the action the board and this company has agreed to direct.

Important action items include:
·A scheduled meeting in January with all builders to discuss community issues, what is expected of a builder who is building homes in Cimarron and also what information is to be made available/presented to all prospective home buyers as well as all contracted Cimarron home buyers.
·A follow-up membership meeting is being coordinated for sometime the week of January 17th with notices forthcoming once date/time/location is confirmed.

COMMENTS/SUGGESTIONS/QUESTIONS: The Covenants are nowhere on the Hunt or Cimarron Website. Update the Cimarron Website, and post the following:
- Covenants Laws/Rules
- Builders Laws/Rules
- Maps
- Community Forum
- Construction updates
STATUS: The website is being revised to incorporate you suggested additions in addition to key meeting dates and minutes, action items and status. The Cimarron Owners Association website does have some of the items requested such as the Governing Documents of the community which addresses the rules. Per your suggestion we have uploaded the maps to the different subdivisions currently in the community as well as the master plan scenario the community is currently being developed under.

COMMENTS/SUGGESTIONS/QUESTIONS: Over 70% of the homeowners were not informed of a Homeowners Association or $210 annual fee.
STATUS: A meeting was held with Lone Star Title to determine how they have handled closings in Cimarron . Examples of documents provided to purchasers at closing are being gathered and reviewed.

COMMENTS/SUGGESTIONS/QUESTIONS: The builders are not telling their new clients about the HOA rules
STATUS: Informational materials including association covenants and general HOA information is being created for builders to maintain in display homes and at their offices. Builder meeting scheduled for January to present these materials and to communicate expectations.

COMMENTS/SUGGESTIONS/QUESTIONS: What happens when the Title Company never had the homeowner sign an HOA letter?
STATUS: Meetings are being arranged with all Title Companies to determine how they handled Cimarron closings and what their liability might be if the HOA was never disclosed. Each homeowner affected will need to determine their personal course of action.

COMMENTS/SUGGESTIONS/QUESTIONS: How many Cimarron communities will there be?
STATUS: Currently there is Cimarron Unit One with a December 2010 scheduled opening of Cimarron Sky and Cimarron Cove. The projected master plan reflects a total of 20 residential subdivisions in addition to multiple other use parcels such as schools, parks, multifamily, and commercial. `

COMMENTS/SUGGESTIONS/QUESTIONS: What is the current number of homes occupied and how many Lots need to be occupied before the Home Owners take control? We were told that the HOA will not be turned over to the homeowners until the homeowners own more land than the Land developer. How can we track this percentage of ownership?
STATUS: This information is detailed in the Covenants and tracked by this office. Transition to the homeowners is gradual. The Bylaws Article 3 outline the steps taken as the Board begins to carry Owner members on the Board and the Charter Chapter 2 outlines the occurrences to complete the final transition to full Owner control. The projected build out of the community for the residential subdivision is 2453 units. The percentage for complete and final transition is 85% (or 2085 units). Cimarron Unit One has a total of 285 units combined of Owners and Builders.

COMMENTS/SUGGESTIONS/QUESTIONS: I live in Cimarron #1 do we need to wait until Cimarron #8 is complete?
STATUS: The community is developed and recorded as one large community and the transition will occur as per prescribed in the documents (please see prior answer for specifics).

COMMENTS/SUGGESTIONS/QUESTIONS: The Land Developer controls the Board of Directors (BoD’s) and is responsible for enforcing the rules within the Cimarron Communities. There are several Builders’ and Homeowner in violations and the current BoD’s is not aware of this because they haven’t monitored or inspected the area. Also, if we have to pay the $210 annual fee then the BoD’s need to enforce the rules and contact the homes that have not complied, such as tall grass, a car parked on the lawn, trailers on non-paved surfaces, wrong land scaping, No landscape in the front, Circle Driveways, and Builders building Track Homes.
STATUS: This company conducts monthly property inspections and issues violation/non-compliance notices. Builders are not exempt from this process.

COMMENTS/SUGGESTIONS/QUESTIONS: I have seen one Builder building track homes on Brays Landing and there are three identical homes in a two block area and this is not in keeping with the look of the majority of the neighborhood.
STATUS: This is a matter the Board of Directors is to investigate and resolve.

COMMENTS/SUGGESTIONS/QUESTIONS: Before more people build new homes the BoD’s need to make sure People READ their HOA laws/rules prior to purchasing a home in the neighborhood and before closing to make sure they can live within the confines of the HOA rules.
STATUS: Perspective homeowners can not be forced to read the HOA Covenants. That information however must be part of the closing documents and all purchasers need to signoff that they have received this information and it is understood they are buying into an HOA.

COMMENTS/SUGGESTIONS/QUESTIONS: If Hunt is the BoD’s they need to request a Stop Light be placed at Northern Pass and Resler.
STATUS: Board of Directors is taking this request under advisement and presenting community concerns to the appropriate city representative.

I believe this refers to the new subdivisions north of Helen of Troy and east of Resler (Northern Pass Drive on Google Maps)

The Covenants for Mesa Hills aren't worth the paper they were printed on. Not enforced.
