If the GOP had run Obenshain or Bolling for Governor instead, the election would have had a much different outcome. Cuccinelli should have run for Dogcatcher and Jackson as Horse Manure Collector.
Yes, Herring has been declared the winner. Obenshain can of course call for a recount given the margin, and it is a freebie. However, historically, recounts rarely change the outcome if ever.
The comments of the Election Board Chairman (title?) were comical - he's the former executive director of the Republican Party of Virginia and REALLY doesn't understand the need to be as neutral as possible in his words to present the image of a fair election...
There is a possibility that Obenshain, if he loses the recount, could ask the VA legislature to contest the election and throw out the results and either (1) declare Obenshain the winner or (2) ask for new elections. Given that the VA legislature has Republican majorities, it is possible, and there isn't a whole lot of specifics guiding the conditions for such.
However, it would be a very extreme measure, and to do so may create a lot of backlash that may outweigh any gains Obenshain might obtain.
