Hillary said the emails were about yoga because she thought most people wouldn't want to investigate further given the ongoing mental image of her in yoga pants.
The appearance looks bad even if there was no quid-pro-quo, I don't understand why she wouldn't think this would come up if she ran for office. People gaining access who also happened to give to the Clinton Foundation is an issue.
The IRS provides for 2 types of foundations, non operating and operating.
The non - operating foundation typically uses grants to other organizations to achieve the intended social impact. The models used by chairitale organization rating agencies only address this type of common foundation.
The operating foundation implements its own programs to achieve the intended social impact instead of granting most of its revenue to other organizations. The operating foundation is typically a recipient of grants from non operating foundations. The models used by charitable organization rating agencies are not configured to rate less common operating foundation business models.
There are thousands of private operating foundations ( mostly family) that implement instead of grant. An example of a operating foundation with a household name is the Heinz Family Foundation that implements its own programs instead of granting funds to other organizations. And then there's the Clinton Foundation.
Those unfamiliar with the fundamental differences between operating and non- operating foundations, look at the Form 990 and focus on revenue vs grant and our of ignorance erroneously conclude that the foundation is a sham operation, operating for the benefit of the family. They erroneously look at gross foundation expenses and assume moneies are being squandered. They tend not to get into the weeds of accounting to distinguish between funds spent on fund raising vs program execution.
As it relates to the Clinton Foundation, it's an operating foundation and self executes instead of granting most revenues. 89% of revenues go directly to program implementation.
