The courts are part of the checks and balances system. They were put in place for the express purpose of acting as a balancing force to public opinion. Federal courts look to see if laws violate the Constitution--not whether they are popular or not.

Courts only uphold laws if the judges are not activist jusges legislating from tht bench. Obama has already said he will appoint liberal activist judges. Ergo, laws will not be upheld

That is not how the Obama camp has sugar coated the whole thing. They are saying Obama will fight for "gay equality" and end their suffering.

LIARS they can't make up their own minds because they do not have any opinions that they can express outright or America would hate them.

OBAMA said at Saddleback, partnership rights no marriage rights. I could care less but I really can't stand these people. I understand you have to cater to ALL voters so you drift into the middle but you can't be so self righteous when you're just a sneak at heart.

Who knows what any politician will do especially this chameleon. I DO KNOW McCain did not have any problem saying what issues he's flip flopped on over the years when he was asked. He knows who he is and knows where he came from, like he said.

Default why, in god's name! why?

Hello, I’m a Dutch woman who came across this forum when I did research for my English exam about the differences between gay rights in the Netherlands and gay rights in the United States.
I find it very remarkable how shallow you people can be... why don't you just let everybody live like they want to! don't try to compare homosexuality with one of those unethical things like pedophilia or other grows mean and horrible things in the world.
homosexuality is love between two people. they are both adults and have every right to make the choice to be with each other, to love each other and to marry each other. when you love each other and you want to be with each other, marriage is for every person in this world the ultimate declaration of love... it has nothing to do with religion or a man or a woman, it has to do with love... and love alone.
you should leave your personal opinion about how grows you think it is out of it... homosexuals are not causing harm to you in any way, they are not going to say you are gay or anything like that, they don't even want you to be gay!
being gay is a gift from god; just like being heterosexual it's the choice that is made for you! before you where born! you've got nothing to choose.
in the Netherlands gay marriage is something we are proud of... we like it that in our country you can be who you want to be! in our country horrible things like pedophilia and you name it are absolutely not allowed... those things are horrible, not between two adults, that's just abuse! but homosexuality is not like that... it is exactly like heterosexuality, just something you are... something to be proud of!
Osama should fight way more for gay rights... I think he's very concretive about it gaymariage should be a constitutionalised right! a human right!

The courts are well within their rights to decide if a law passed through the legislative or voter initiative process is unconstitutional, and to strike down any that are.
