This is funny. Fox News aired the wrong ad and showed a better one, in my opinion. LOLOLOLOL

What would be illegal about the one that aired?

They say it's express advocacy which under election reform laws cannot be paid for by any corporate sponsor or nonprofit group.

Think Progress » Fox News Accidentally Airs Controversial Right-Wing Ad That It Had Declined To Run

Having said that, while the ad may be bad form, I do believe it was a mistake at least as far as the front lines go. The reporter seemed honestly shocked to me.

And to quote a legal expert at everyone's favorite site:

"The ad indisputably concerns an election, takes a position on the character and fitness for office of a candidate, and raises no legislative issue. Even this highly skeptical Supreme Court would turn up its noses at the foul odor emitted by this clear abuse of federal election law."

Sorry, I can't find any other valid sources on the issue to test the veracity of that claim. Perhaps later one will come up if/when other news orgs begin discussing it.

The reporter is taken aback but Shepard Smith seems to make light of it...not sure if he was surprised either. Either way, don't see anything coming from it.

It doesn't seem like a serious offense to me. Accidents happen. Once, that is. If it becomes a habitual accident, then I'd be concerned.
