This is getting repetitive - and predictably so!

Obama challenge rejected


UPDATE: Ohio Secretary of State Jennifer Brunner will not have to prove that Barack Obama was born in the United States or take his name off the ballot, a Warren County magistrate decided this morning.

The decision itself is not online yet, I believe.

But, evidently, (as usual) there was no evidence to support the contentions made.

ETA: Typo in heading - it should be CASE, not CAST.

Further update, from the decision:

It is abundantly clear that the allegations in Plaintiff’s complaint concerning ‘questions’ about Senator Obama’s status as a ‘natural born citizen’ are derived from Internet sources, the accuracy of which has not been demonstrated to either Defendant Brunner or this magistrate.

Of course he isn't a citizen. He has a funny name and his skin is an unfortunate shade of brown.

These judges are Al Qaeda plants. They're all in it with Barack Hussein Obama. This country is being taken over by Muslim terrorists!!!

Of course, all the cases are moot now, except for the "but what about when he went to Indonesia?" crap buried inside Berg's motion.

And that one is pretty easy to figure out, if you bother reading U.S. law.

Berg is left with the stance of "But... what if he swore an oath to somebody else?! He should have to prove that he NEVER swore an oath to another country!"

Even there, he still loses on four different grounds.

1) He still has no standing.
2) He still has no evidence that Obama swore to anything.
3) For the part of the US Code he is using, it is clear that the burden of proof is on Berg, not on Obama.
4) The law itself is clear that unless such an oath was taken in front of a U.S. representative, it was not binding. Neither Obama nor his parents had the power, otherwise, to change his status as a U.S. Citizen until he was 21 (the law at the time).

All those people wasting all that time and money on Atty. Berg's wild tales, along with the rest of the idiots around the country "who relied too much on what he read on the Web."
