I dunno. seems like it's been the norm lately to vote away people's rights.. like gay people's court given right to marriage.

Your argument doesn't hold any weight unless you're willing to address BOTH side's blunders in your premis for constitutionalism...
Seems righties like to scream foul when rights they uphold and respect are being challenged and looked at.. but are quick to get to the voting booth to stamp out other people's rights appropriated by the constitution and the courts of the land.
You can't have you cake and eat it too.. so which is it?

Well I actually do think its pretty much impossible. In 2006 the Democrats picked up 31 seats in the House. They had huge leads in the Generic Ballot Congressional polls, and huge leads in the rating the party polls. If the GOP is going to have a major pickup similar to the 31 seats the Dems picked up in 06 (or even more than that like the 40 they need to take over the House) they need to start taking some pretty large leads in these polls. Not only do they not have large leads in these polls, for the most part they don't even have the leads in those polls outside of perhaps a poll here or there. Considering midterms typically go against the President's Party (exceptions 98 & 2002) I do expect them to pick up seats. However, when the Generic Ballot is Dem +2, Dem +4 or even GOP +3, they simply aren't going to pic up anywhere near enough.
