The state can charge someone with aggravated assault when the state determines that the evidence is there to pursue such charges, regardless if anyone files a complaint. You've got one of these guys lying to the police until his wife outed him, which shows an awareness of wrongdoing. And aiming a shotgun and firing that shotgun at another person, even though they were wearing a bulletproof vest, is purposely engaging in behavior that could cause serious or grave harm, which meets the definition of aggravated assault. In cases like this, the prosecutor will often pursue the more serious charge, to have that leverage going into plea bargaining.

This firearm incident is pretty low on the stupidity scale, at least they were wearing vests and nobody died. How many kids die or kill someone every year because the parents didn't keep their loaded guns locked up? that's way dumber than what these clowns did.
