So sorry to hear that. I really hope everything works out for you, sometimes going back is the only thing to do. If you could find out who the owner is, maybe it might help if you speak to them and inform them of your situation. What's the worse that could happen?

i looked at my lease it has the name on there, ive been trying to google it but havent come up with anything

Chris,

Check out Marion County Property Appraiser

In the website menu (on the left side of the screen), choose "Property Search" and you can search for the owners current info right from there.

To answer your earlier question, no, it won't cost them more to sue you than you owe. They'd likely sue you in small claims which may cost them a total of $100 or so. Some landlords pursue in court each time after they've tired of tenants breaking leases, etc. Remember, it's not just you - the landlord has probably been down this road many, many times .

If you end up in court, the landlord is almost guaranteed to win. An inability to pay is no excuse legally. To top it off, you will probably be back in Maine at the time you are sued and you won't even be able to appear in court (in which case, you automatically lose). It's a business and you broke your end of the deal, there are consequences.

Your best bet is to appeal to your landlord as others here have suggested (through the property manager if need be). Explain that as much as you'd like to stay, some personal issues have come up that make it impossible for you to do so, so you'd like to work something out and be able to leave on good terms. Offer for them to come in and look at the condition of your apartment (hopefully it is spotless and with no damage), and offer for prospective tenants to view your apartment while you are still living there (maybe they can get someone to move in right behind you this way). You might also offer to pay for September and October's rent.

There's a good chance that the landlord would rather work something out with you now and come to a setlement agreement rather than pursue you legally. You'd probably rather get it over with now too instead of risking having your wages garnished later and your credit hurt.

Thanks Guys o nthat site it says the owner is From New York but no phone number maybe i can get that in whitepages

We are not trying to ripp them off we just cant afford it now that main has cut off our adoption money, we could stay here and not pay the bills as we broke right now

Sometimes it just depends on the apartment company. I moved out with a month to go. My apartment rental complex had undergone numerous management changes and was totally sleezy. I wrote them a letter detailing all the problems I had with them as well as let them keep my deposit. I've heard nothing and am not going to worry. My present landlord knew of the situation & didn't care as long as I paid my deposit to him. It all depends on the situation. They can threaten to make you pay, but here, in Florida, I think most places try to keep your deposit anyhow.

It doesn't sound like you are trying to rip them off at all, and I don't imagine the landlord will view you that way either, but your problem is not your landlord's problem. Your landlord has a different problem which is that he/she counted on you to fulfill your commitment and now you're not going to. The mortgage company will not accept excuses in lieu of payment, so somehow the landlord has to cover the shortfall.

I only say that to help you in your negotiations with your landlord, to help you view it from their perspective. If you help your landlord solve THEIR problem, you will probably get out of this unscathed. This is what I was suggesting to you earlier with offering to pay an additional month or whatever you can work out. If you now want to "renegotiate" the deal by being let out of the lease, it has to benefit both parties. That's what is fair.

The worst thing you can do is dig your heels in the ground and just say "I can't afford to pay". This will not hold up in court at all and you don't want to end up in court over this.

What does your lease say? It should be written very clearly in your lease. When I broke a lease all I had to do was give 30 day written notice and pay 2 mths rent. They are asking you to do the same....just pay up and be done with it. Make sure you get it in writing.

thing is i cant afford to pay more than one months rent. neither one of us are workintg, have applied multiple places, we have my disability money and had adoption money but thats gone so we down to 555 per month
