Hello. I am moving to Florida for school. I signed a rental agreement to move into a single family home from Sept. 28-Feb 28, 2014. I paid the security deposit but just found out that my school will be rotating us, so I will not be able to maintain a permanent residency. The landlord has not given me keys and I have not seen this home in person. I emailed the landlord stating I need to break the lease, but she has not responded. What am I looking at losing? Its more than 1 month before I'm supposed to move in. The lease is a standard Florida lease.

I would give my utmost effort to get in touch with the landlord. For your protection and documentation, I would suggest that you make written contact with him/her (email and certified mail), plus maintain cell phone records of your efforts to correspond. When you signed your lease, you bound yourself to the terms of a contract. The absolute worst case scenario that you would be facing would be a requirement to adhere to the full terms of the lease, even if you never move in; 5 months of rental payments. Rarely does this happen, however, as the landlord is required to mitigate his damages (a requirement to find a replacement tenant for you)..... but in a poor rental climate/area, it is very hard to predict what a judge might rule.

I would review the terms of your lease. Are you able to sublet? Realistically, will it be difficult for the landlord to find a qualified tenant to replace you? Is the landlord open to you finding a replacement tenant (and will he refund your deposit if you find one)?

Sorry, but I cannot give you the direct answer to relinquishing your lease obligations. You have a signed contract that you (and the lessor) are required to fulfill. Hopefully, your landlord will work with you, and you can walk away as inexpensively as possible. Good luck!

Thank you so much for your reply. Actually the landlord requested 2 months rent for breaking the lease early. I did sign the contract which stated she could do so if I termininated our agreement. So, I am biting the bullet and staying at the house and will try to figure it out somehow. I can't afford to pay that amount and find another residence.
