The owner already accepted payment, he has no case.

It would have been theft if they didn't pay their bill, they did. If the owner wanted to press charges he shouldn't have took any money from the couple.

Mandatory 18% gratuity?? WTF?? No wonder the service sucks.

I have never heard of a mandatory gratuity unless for large parties.

The story is a little unclear on that, but I understand that they were part of a group. Probably if you're all eating together, even with separate checks, they'd consider that a group.

I wouldn't have paid it either, and I was happy to see the Pub getting absolutely trashed on Yelp's reviews this morning. Some of the user submitted photos were hilarious. (but disgusting for those who'd rather not see such things)

Hopefully this is one of those cases where there IS such a thing as bad publicity. Whoever called the police is a moron to think this wouldn't happen.

Yes and it would have been stated on the menu that a gratuity is added to parties of a certain size. If they had a problem w/ that they could have dined elsewhere. Nowhere did I see that they communicated there was a problem w/ the service till it came time to pay the tip.

Every server in that town is going to remember their faces. Hope they don't like going out to eat a lot! LOL.

Tip is and acronym for "To Insure Promptness." Sounds to me like the tip was not earned.

I've been in restaurants before that require a tip when the party has 8 or more people in it. I don't leave much of a tip if the service is lousy. I don't blame them for not leaving one.

That is absolutely the most ridiculous thing I have ever read. No way can anybody (or should anybody) be arrested because they didn't tip. IT'S THERE CHOICE! If not tipping is a crime, then I think a lot of people are in trouble.

People need to grow up. Period!

That's really outrageous! I always pay the tip when in restaurant, but making tip a mandatory payment is too much.
Hope, the judge will make the proper determination.
