It all depends on your state. Texas has “Cottage Food” laws that cover homemade goods and their sales.

get with your county health department to see what regulations, licenses, etc., you are required to have. Most demand a commercial kitchen (you can usually find one to rent somewhere), and proper labeling.

I think we see this all to often. around here, I always wonder, are the Amish, or are they dressed up to act like one? As for selling a product with out a certified kitchen, I don't know for certain, but I doubt those selling breads, jams, etc at our local farmers markets have certified anything.
