This thread has to be a troll thread. you are going to sue because you didn't get your earnest deposit, which after reading this if my timeline is correct was due after the home inspection?
If that's the correct timeline here, the buyer is bailing out using a contingency. why bother giving you the earnest money when the contract is not going to proceed? I don't know how much you were expecting the earnest deposit to be.. I know for every house I've looked at i only put down $500 for the earnest deposit.
There's no damage here, you are just bitter because after a year somebody finally decided to take a closer look at your house and did not like what they saw. I don't think asking for termite treatment is a big issue.
Remember it's a buyers market, there are loads of houses on the market for people to jump ship to in-case they did not like yours upon a closer look. Put some money into it, fix the issues, try again.. and have a beer and calm down..
