So i got papers about my foreclosure. One of the 1st few pages says the mortgage company moves for summary final judgment, but the final page says they moved for voluntary dismissal without prejudice, dated march 28 2013.

So is it dismissed for now, or what does it mean.

Post this below in the Realtor forum and you will get your answers. Be careful, you really need legal advice as each State is different and we here in Florida are one of the worst at enforcing Foreclosures. Which incidently is a primary reason we still have so many.

Get Lawyers involved and in the end, they are the ones that make money. Our Legal system is PATHETIC!

My guess is......... The lawyers for the banks are asking judges to dismiss their cases. The banks are just taking a breather before refilling with stronger evidence

Without predjudice in legal terms means they are withdrawling from legal action. But they reserve the right to re file charges at a later time.

AKA in layman's terms. They are just delaying things until further notice. You have some time before they refile again.

Bout how long till they file again? Is there a minimum they have to wait?

Every house is unique. It could be 2 days from now, or 2 years. There are no rules.

My mom died 2 yrs ago with a mortage and no will. I her daughter have been living here for 2 yrs. I can no longer pay the mortage or taxes. what will happen? i do not qualify for a Mortage. The taxes are also due

I work on these situations regularly. Since it was your mothers loan and she passed. You need to show her death certificate to the mortgage bank. Then you can try for a loan modification to reduce your payments.

You saying can no longer pay the mortgage or taxes is a problem. You have to show a minimum income to show you could afford the smallest modified payment.

You do not list enough information to comment further. If you provide;
  1. State are you in
  2. The Mortgage Bank
  3. The Balance
  4. Type of loan (conventional or FHA)
  5. Home Insurance and Mortgage Taxes.
  6. Explanation of your income (SSI, W2, Rental, or Self Employed)

I can give you a ball park idea of a new modified payment, plus what income you need to show to qualify.
