Many years ago we rented a house from a private owner and we had him put in the lease that the house was not to be offered for sale as long as we were in it. I didn't want it sold from under us and have to move again.
Never did I think to have in the contract, "landlord must be paying the mortgage and not allow house to go into foreclosure." LOL

Got to be honest with you, I'd tell you to find another place, even if you decided you could do without that clause.

Now her info could be wrong. But this is what she was told by the attorney. But it's her divorce attorney not a real estate lawyer. The woman was just trying to do a little google work to help my sister in law out.
And she's been sending rent to a P.O. box and doesn't even know how to contact the friend. She's not hopeful of getting her deposits back.
I'm not going to tell her what to do, but I'd opt for an escrow account with the attorney for my rent payments. This way I'm paying rent but not to a crappy, irresponsible friend, especially if that friend doesn't own the house anymore.

A. Your sister got information from a divorce attorney. Bad advice.
B. Why do you assume this person is irresponsible? How do you know she isn't trying to modify the mortgage? How do you know there wasn't a catastrophic illness?
C. I know people that have been in modification for over five years in Florida. Multiple people for various reasons.
There are also many, many property owners who get a notice of foreclosure who bring the pmts current before it ever goes to auction, or who file bankruptcy before it goes to auction, which halts the foreclosure.
Don't let your sister stop making pmts. She can be evicted.
