My brother-in-law is looking to buy a house. The house he wants has been on the market for a long time, and it's in pre-foreclosure. The owners are underwater on it. He submitted a lowball offer, waited a long while, and then talked to the listing agent, who said it was too low so he didn't even show it to the sellers. Then he submitted a new, higher offer. The real estate agent then came back to them and said that the offer was too high, and he needed my BiL to submit a LOWER offer. This seems incredibly sketchy, but nobody has any idea what game this guy is playing. Why would a seller's agent ask a buyer to submit a lower offer?

IIRC a Realtor has to submit any offer, regardless.

Sounds like the listing agent doesn't know how to handle a short sale. Also he MUST submit any offer to the sellers unless the sellers specified in writing for the agent not to present offers under a certain $ amount.

Anyone that doesn't know how or is unwilling to submit your offer, you should get another realtor. It isn't up to them to decide if it should be presented or not. Certainly there are a few realtors in the area who know how to do business properly. Ask around. One of the best places to ask is your real estate attorney, because they have done business with a ton of them and know who to use and who to avoid.
