I think thrown out is more appropriate. You can also file a complaint with the local Realtor Association. Unfortunately, it's actions like this that give our industry a bad name.

SO the attorney said today we could back out or push for the money in the difference in the appliances. The listing agent will not give and money back. Never do bussiness with Keller Willams. The lsiting agent (KW) told the family to take everything the house was sold as a short sale.

I doubt Keller Williams as a company endorses this type of behavior. This is a problem with the agent. You should discuss with the managing broker. If the broker won't offer to correct the situation and if the KW agent actually told the family to take everything contrary to the contract, then perhaps you can threaten legal action against the agent and the broker. I'd ask your lawyer to write a letter to the broker stating such. Sometimes the threat of action is enough to get a positive response.
