Been trying to make sense of this issue by reading what I can about the on going dispute whether to replacing the lift. It seems now like the last I can find, Lee County is going to sue Cape Coral because they city wont replace the lift?
Has anyone heard anything more on this?

in a nutshell.... barrier was built to handle a certain amount of water to divert through mangroves. the amount of water far exceeded the amount they envisioned 40 yrs ago whether it was the strength of the tidal flow, rising ocean levels, more water going into canals due to less soil absorbtion,, who knows.

barrier was removed because it was doing harm rather than good. The DEP gave permission to take it down. turned down permission to rebuild. the county appealed the decision and it was dismissed. The last meeting the city and county decided to put off meeting for 6 months. The longer it goes on the more data is available to show that there is not a need for it. There has been plenty of manatee, juvenile tarpon , snapper, mullet , sheepshead, catfish. all in the canals. last I checked manatees are protected if they are making it their habitat good luck getting the barrier rebuilt. My guess is it will never go back in and the city will do other things to keep the waters clean. Phil buchanan and the other people who want it back installed will have to decide how much they want to spend to fight a losing battle.
