I have a rental unit, and the lease expires on the 31st of the month. I gave a 60 vacate notice. Earlier this week, I notified the landlord that I would be moving out on the 28th. Unfortunately, I just found out, my new unit will not be available until the 3rd of October. I notified my landlord and he said he has someone moving in my unit on the 1st of October. Moving in and out can only be done on a weekday, per the Association.

He said my lease is up on the 31st. Since this is the case, technically I have to move out by the 1st. My question to you is – Can he force me out for staying two additional days?? I am willing to pay the two day differential.

September has 30 days not 31. If you have to be out on a week day, it would seem you need to be out on the 28th, a Friday.

However, since your lease runs to the 30th ( not the non-existent 31st ) , it would also seem you should be able to move out on the 29th- a Saturday or the 30th, a Sunday. Although by telling your landlord you were moving on the 28th, he likely expects to have the 29th & 30th to do cleaning , etc. for the new tenant. I suspect he wants you gone on the 28th as he seems to have planned around that.

It would also depend on what you paid him- did you only pay him for 28 days, or did you pay a full month's rent ? Did he accept 28 days payment?

You need to talk directly to your landlord and work this out with him.
