I got that offer for the 10 free trees AND a lilac bush...sorry to say.. they all died!!! I would suggest buying plants and trees are better done at a local store. That way you can see exactly what you are getting. I no longer buy anything via mail order. Even if they replace or refund the money, I'm still without a plant for a year..

In case of tree damage, Their homeowners insurance is responsible since it is an act of god.

But you could possibly be liable for damages in a civil court if you can be proven neglible, like it was a completely dead tree and you refused to have it taken down. Most of the time though, no one has any control over the wind and how they will affect the trees. I have had perfectly healthy trees branches come down.

As for leaves, Leaves fall where they may as nature dictates and the owner of the tree is not responsible for raking them up or cleaning out the neighbor's gutters. Likewise, if the neighbor tries to dispose of leaves by blowing them into your yard, it may be considered harassment.

They can trim branches UP TO the property line that encroach his property. But that is all. And they cannot disfigure the tree so much that it harms the tree or they will be liable for damages.

I am UP on all this stuff since I have a NFH.

Yes, I got the Colorado Blue Spruce deal. I grew to love these trees when we were in Colorado. I have one left. These trees seem to grow here for a while and then they die. My mountain laurel died after being beautiful for years. I almost cried.

Actually the trees that are doing the best in my yard are the ones I got from the woods in this area. I have an acreage that I get them from, but trees sometimes are planted by birds along the road right of way. If you stop and ask the person who owns the land, sometimes they will let you dig up these trees, because they know that will save the tree since the right of way mowers will destroy the tree when they come along. We all like to save trees.

I got 10 free trees by joining the Nat'l Arbor Day Foundation, but none survived more than 2 years unfortunately -- they were just too small and I didn't have the time nor knowledge to coax them along. One of them, a Hawthorne, was so straggly when it arrived, that I ended up curling it around itself - that was kind of neat and it was the only one that lasted the longest.

Over the years I've not had a lot of luck with mailorder trees, bulbs, plants and I've decided to stick with the cheap things from Lowe's, Home Depot, WalMart, etc. for fun, and spend the dollars at a full-fledged nursery when I'm doing serious landscaping.

MA to WI to PA and now FL

I wanted to report back that Arbor Day got back to me and said they could not ship any trees to my location (southern NM) due to agriculture restrictions or something. When I ordered the trees through the website they said plants would be chosen based on my zip code - I guess they were only kidding.

Bummer.
