Cutting down a tree with a nest! (2013, back yard, frost)

I have a scraggly holly tree in my yard that has been long considered for removal. Mother nature settled the question by killing off a big chunk of the tree last month (Frost? IDK)

No hurry to do this. It's prickly so I can't just whack it down. We've been gloving up and snipping off 3'-4' long branches, putting them in cans on the curb for the weekly pickup. Yesterday I was doing my quota for the week and realized that there is a bird's nest in the tree. Next week's trimming will leave the nest very exposed. I can't tell if it is old, new, being used or what.

Any suggestions? I don't really want to leave that scrawny tree with just a birds nest in it until winter.

No eggs, remove it immediately before any are laid. The bird will build another nest somewhere else. Even if there are eggs, they'll hatch in a few weeks. Wait unti the chicks leave and remove the nest before another crop of eggs appears.

use a saw, a nest will likely come apart in your hands right away. a herring won't work either

If your reason to cut it down is because it looks killed off at some parts then don't. It should come back as mine did last year.

Here's my Cold Hardy Holly Tree.

Historic deep snow pack preserved the bottom while the top froze off. Looks like it's starting to come back in recent days. Not worried about it. My back yard ones came back in the summer of last year after a hard winter in 2013-14.
