Nope, haven't gotten anything like that myself. Googling it only turns up stuff from 2013 when they had to stop using health reports.

Yes I got one. I don't exactly understand who is suing them and for what reason. I have not gone on to the website indicated to either join the class action or opt out. Maybe someone else knows?

I hesitate to go to the website because the message was in my Junk Folder and it woke up my antivirus. I looked up a forum where someone posted a copy of the message. Short of it is that said there's a settlement - I don't know why - of $12.50/kit purchased within a time from up to late 2013 or a $40 certificate towards another kit. Ihaven't tried to go to the site yet. Can't find anything in the news. Weird.

I got it too. I don't want another kit so I'm ignoring it. I just wish they (or someone) would tell us what this is about. Makes me curious. Did 23andMe do something wrong? I know I did my testing just under the wire, right before they had to stop giving out health reports. So I wonder if the timing has something to do with it.

It must have something to do with the class action regarding their health reports back in 2013. Although it's all sorted out with the FDA now, maybe a part of the settlement was to give a partial refund for those who purchased kits with the original health report. That is common with settlements like this but it can take years to finalize. I got a refund on a certain amount of ebooks I bought during the period when publishers were conspiring to raise ebook prices. As part of the settlement, they had to refund X amount for each ebook.

I think I bought my 23andMe test in 2014, because it was after they discontinued the health report, so it would make sense why I didn't get an email about it.

I can find nothing about it on their website. This is badly handled imo. Sending them an email. To be ignored? We'll see.

A class action was filed immediately after the FDA blocked 23andMe from issuing the health reports. Basically, the complaint alleged there was no scientific data to back 23andMe's assertion that the identified genes raised or lowered one's risk for certain diseases, i.e. False advertising. (There was also an allegation that 23andMe improperly sold data obtained from the kits but I don't know if that was included in this particular claim.)

In August 2016, the 9th Circuit Court of Appeals affirmed a lower court's decision that the case belonged in Arbitration, not court. (Huge loss for class action attorneys).

Davis-Hudson, et al. v. 23andMe, Inc. Settlement

As noted in the above link and indicated in a prior post, an agreement has been reached between the parties. Choice of $40 discount on another kit or $12.00 and change in 'cash'. The attorneys are requesting up to $2+ million in fees (and costs?). I usually support attorneys' fees but certainly not in this case.

Dates of purchase are October 16, 2007 to November 22, 2013. Automatic certificate for $40 off the cost of a kit for those that don't choose $12.50 in compensation for each kit purchased between these dates.
