How do you go about adopting a child if the parent wants to give the child to you? Is that legal?

Yes, it can be done legally. However, the paperwork should be drawn up and properly taken care of by a lawyer so that everything is done correctly.

No, you can't and should NEVER adopt a child without the services of an attorney that specializes in adoption law. You're referring to what's called a private adoption. It won't be very expensive and must be done. You'll need to go before a judge for the final adoption. You need legal counsel to protect your rights and to make sure that everything is legal. I don't want to sound sarcastic, but if you don't have the money for an attorney, you should think about if you have enough money to raise a child.

I agree with Lisa. I adopted my son from Russia and did not use a lawyer. I did the paperwork myself and he been with me for four years now. But, the way you are doing it..I would get an attorney. I dont know if there is a legal aid here in GA there is in PA for families who really want a child but cant afford attorney fees. I didnt use a attorney for my adoption and saved myself close to 8k. Lisa's last remark struck a cord with me..I've seen loving parents who dont have money but there is a lot of love in that household that rich folks wish they had. I say go for it..try and look online for the legal way of doing it if there isnt..then maybe talk to an attorney and ask him to take payments..some lawyers do that. Lady V,

My husband and I are actually going through the SAME situation. I contacted our Department of Social Services and found out that you CAN do the adoption yourself as long as BOTH biological parents consent. What you will need to do is contact your county Clerk of Courts office. You will do the homestudy and once it is certified take it along with the petition to adopt and consent forms to the Clerk of Courts. They will handle the rest. Once it gets to your DSS, they will notify you. Once DSS has processed it, it will take at least 90 days to finalize.

You should be able to pick up all of the paperwork that you need from your local Clerk Of Court. Our entire adoption is costing us approximatly $1800.00 (and I am including "just in case money" with that quote.)

The REAL parent is the one who raises the child; not the one who gives birth to him/her. Just a minor tweak in your wording.

Contact your local social service agency. I'd guess they can lead you to the right information. What works in CA may not in TX and so on.
