I have a patio adjacent to my bedroom. Since living on the first floor, the patio is half open and half enclosed by fence. The residents upstairs have a patio like mine. While since it's on the second floor, theirs is fully closed.

I put a chair and a pillow in the patio behind the fence, with nothing posing risks to safety. The leasing management entered my patio to say we are forced to remove the things on the patio by certain date.

The patio is stated to be a part of my leasing per the floor plans, and I assume the property management should haven't been able to step to my patio without notice, and even told me what I should have put in my patio. Likewise, they won't be able to regulate what the residents on the second floor should/not put on their patios.

I was wondering if I am supposed to abide by this property management's requirement or even the management has illegally trespassed the patio.

I know you are not usually allowed to have charcoal or gas grills on apartment patios and balconies.. and usually there are stipulations about not storing junk, trash or even bicycles on an apartment patio, but you are not allowed to have a chair on your patio? What kind of chair was it? It seems if it was a chair specifically for outdoors I cannot possibly understand what the issue would be.. I mean what are you supposed to do with your patio if you cannot put a chair out there and enjoy it?

Thanks for the reply! The chair is just a fordable chair and the pillow is a round shape body-fit cusion that you can sit on it. So the leasing management doesn't have rights to force us to remove them from the patio right?
