Hi, so I tried to be courteous moved about a month early while still paying rent because I got a deal on the new lease and I always like to leave enough time to clean up. Turned in the keys on April 8th and have heard nothing since. I texted about a week ago to see the status of my security deposit and the landlord just said he was out of town and hasn't had any time to do anything yet. Which I find absolutely ridiculous because I gave them a month to clean or fix anything and they basically don't seem very eager to get someone else in there. Now I know in Ga they are supposed to return the deposit within 30 days but I am not very clear on what happens after that. I'm assuming I'd have to take him to small claims court unless he cooperates but at that point has he forfeited the right to take anything out or my deposit for repairs?

We didn't leave the place a wreck but the I just don't know how this guy will handle anything. We were renting from his daughter and she sold the house to him so I'm not sure what he's doing. She said he rents other properties but I'm not sure how many. I know there's different rules for landlords who oversee more than 10 properties but I'm not as clear on the rules for those who own less. And I'm just not sure if he's just stupid, forgetful or thinks I won't bother trying to fight him on it but I'd just like to know as much as I can to be ready come May 8th when I have to argue about it being past the 30 days.
