My mom passed from dementia back in November. She was 96, the dementia was stage 4 Alzheimers, and she had gotten paranoid and thought I was stealing from her (after taking care of her for 15 years after my dad passed). My brother had stepped in during the final year, and then she fell and went in the hospital, and nursing home for a few months.
Anyway, I'm the executor, and I thought I was fortunate because I have legal insurance, and I get 9 hours with an attorney through the insurance. Lucky - NOT. I'm selling her mobile home (which is not real property, it is personal property) and because I was not ready to fill out the Affidavit of Small Estate - because there are expenses I don't have a handle on yet - the attorney recommended by the insurance is closing my claim. I talked to the attorney for ten minutes, and they sent out two forms. No way was there 9 hours of work completed. I'll be calling the insurance company on Monday to complain.
I'm not looking for legal advice, but I'm looking for the steps to take to finish this, when I'm ready. Yes, I've tried googling and I'm not finding a clear answer.
Where or with whom do I file the Affidavit of Small Estate, in California? There is no probate.
Any help or push in the right direction of the steps that go down - I have some expenses, and I have four siblings to distribute to - would be a great help.
As with any distribution of assets, document, document, document. Then provide copies of that documentation to at least three independent individuals or repositories. Legal challenges often occur only at the last possible moment within a statute of limitations. Having multiple confirmations of proper actions short circuits such games.
As this is not specifically a grief or mourning question, but may be of use to others in such a state, it will be held open for a couple of days for comment by those who have direct experience with it, and then closed.
