We are getting ready to put our house up for sale - moving to Florida. We still have the original deck on the back of the house. I bought the house in 1989 and it was already there. Naturally, the building codes were different then. While most of the deck is still in excellent condition, we did replace some of the decking boards. The original deck did not have spindles from the handrail to the deck. I know that current codes require them. I want to avoid future inspection problems so we went ahead and put lattice between the handrail and the deck so there is no opening wider than a 4" ball can get through. My question is this. What about the stair risers? Currently there is only a 2X6 halfway between the handrail and the stairs. Will this be "grandfathered" since we didn't actually replace the entire deck? Any builders out there who can help with this question? I REALLY appreciate it!

ubc dictates risers run between 4in and 7. inches,.... call your local building inspector to find the correct height, i wouldnt worry too much about it, most people arent looking at the deck steps, and if it comes about go buy some stingers from homedepot and throw a new set up two hrs max!
