This happened in Flower Mound Texas, about 5 years ago. Near Fort Worth.

Scary, but true.

Yes, this is scary. I remember this case. I agree with the neighbors that it's not fair to have someone who didn't really pay for the house living there, when they had to buy their houses through the proper channels & pay a lot of $, etc. However, I'm not sure if this guy still lives in the house at this point.

Almost happened to us with our rural property. Caretaker started moving all his trashy stuff onto the property, put up a sign to board horses....we had to evict him with a lawyer and police.


Scary stuff indeed.

He has a bunch of mortgages and they keep sending him the money and he is happy. The mortgage was still full filed against the property and property taxes were paid and he was paying my dad.

For all we know, the original papers address this - that the BUYER has to pay off the mortgage if he wants the house.

Anyway, the statute in question is not created to rip off regular folks. It was something due to the GWB Housing Crisis and other such things where bank would not inform homeowners for MANY years (who usually weren't paying mortgages) that anything was due. In other words, the banks just never got around to even claiming the property in town hall (foreclosures, etc.).

So the courts ruled they (banks) have a certain amount of time where they HAVE to do something....they can't just show up in 40 years and claim ownership.

This was different since the guy continued paying, etc.

Who is paying the property taxes? A $300,000 house in Texas can cost up to $9,000 a year in property taxes.
