Clearly the landlord has some reason not to want to enforce their own no-smoking policy with these tenants.

Personally I think you have nothing to lose at this point by going over there in a friendly way, and seeing if they'll talk to you. If not, nothing lost, and you just need to get it in writing from the landlord that they'll allow you to cancel your lease without penalty.

I suggest you get a big bag of Doritos, and some cold beer, and head on over to talk story...

You do realize your list is for tobacco smoke, correct?

The properties of tobacco smoke are dramatically different from those of marijuana smoke. I remember in college my ex-girlfriend's roommate smoked marijuana heavily, but you literally could not tell if she wasn't there. It doesn't linger and stain as tobacco smoke does, but it can be quite strong at the time.

I do understand that different people have different levels of sensitivity to smoke of all types though, so what may have not affected me or been discernible by me could very well be a problem for someone else. I get it, but I still think that it's a little overboard to suggest that any landlords would do anything close to that list you provided except in an extreme situation.

I think it just seems that this is the perfect situation just to have a little chat with your neighbor to try to hash something out (no pun intended). I certainly wouldn't be afraid to chat with a smoker who was doing something that is semi-legal (legal, but not allowed in the unit itself), but that physically bothers me.

I just feel like escalation should generally be an option you take when dealing with people that have rejected friendly overtures. If you do end up staying neighbors it's difficult to regain trust when people know that you'll run to the landlord instead of addressing grievances directly.

If the person makes you nervous, bring someone else with you.

You feel comfortable approaching known drug addicts then go for it. To me, a terrible idea - unsafe - and dealing with other unsavory characters isn't something I would ever recommend.

Personally, I'd call the police - that way they and the landlord are on notice - and there is a written record in case you need to go to court.

But my favorite part of the thread is how marijuana smoke doesn't do damage like tobacco smoke to an apartment. Yeah, right. Spoken like a true stoner.

The fact that you don't know what people are saying says alot. I give you that physically your there and on a superficially surface level you are there.

Sure continue to call the cops and everybody else to solve every difficult social issue, intel one day you run into a cop who is a brother or cousin of the guy your complaining about, then you go to his sargent to complain and find out that the sargent is also related in someway. In all your finest mainland thinking you decide to goto the D.A. wait the D.A went to the same highschool as the guy your complaining about etc etc. Sounds outrageous? Its happened. Small world Hawai'i is. So instead of solving your problem by just being humble and having aloha and saying hi to the pakalolo guy. You now have a bad rep.

Its shouldnt matter what class of person it is all people deserve aloha and respect intel proving otherwise. No one is saying illegal drug use is ok. What is being said is "this is an island" And interpersonal skils are important There only so much land.

Thanks for your comments, first we did approach it with Aloha, our enclosed lanai also has their units bathroom window and it comes right on in to our space. they told the landlord they would not smoke anymore on the property, but that hasn't happened. thank you for all your comments

there are other issues also, working on getting out of our lease. We were promised that NO DRUGS or SMOKING of any kind would be tolerated on the premises.
