The mailbox owner may be held liable in case of collision....
All mailbox posts are built to USPS specs. As long as you dont pour concrete down the middle of metal/plastic pipe you are within code. Also the front of the box needs to be 9-12" back from the end of the edge of the road. Which amounts to about 18" distance for the post from the edge of the road. Thus for a car to physically hit the post their tires have to physically leave the edge of the road. Which is thus reckless driving by failure to maintain control of your vehicle (even under adverse conditions).

As to right-of-way your logic falls thru in the case of power posts or trees. Many of them are within two feet of the edge of the road. And if you havent see the new power posts, they are now made of concrete and not wood. Thus if a car veers off the road, no matter the reason, the driver is fully at fault and responsible for all property damage.

I think mailboxes make a statement about the owners. There are many websites that offer very unique mailboxes. They are a pain in the neck to even deal with so when the task does come up, I say do it with a bang. One that will last a long time and look nice. A house in my sub has a custom one where the address is already engraved on it. It's nice.

Then there is a hillbilly that lives on one of the roads out in the country that made his own. He took a plastic container that once held cat litter. He turned it on it's side, attached it to a post, then screwed in a mail flag, took a piece of plywood and assembled two hinges to make the door.

Again, I think a mailbox makes a statement about the owners.

Integrate the post into the design of the box as a single theme:

Awesome! That mailbox would need its own security system in my neighborhood, though.
