If someone is in your driveway for anything more then a quick turnaround, they are trespassing.

I live in CA and a closed door means nothing.

My mom has a little shed in her backyard behind the house, once when we were away, someone went in their and wrecked the interior, even defecated in there!

We called the police and when they came they basically told us because we didn't have a fence and the shed, even though it had a door, was shut, and is behind our house, it wasn't trespassing.

We are pretty sure it was the neighbors who would have drunk parties who did it, but obviously couldn't prove it. We had to clean up the disgusting mess and my parents put in a fence around the property. Talk about a stupid law! It was ON our property BEHIND the house, so not only did you have to walk up our driveway, but around the walkway that wrapped around our house (well away from the city walkway since we are already past the driveway), and then go into the backyard... SMH.

Of course laws vary from state to state and also between communities.
Cops' take on the laws sometimes differ from a court's findings. If this were really an issue, I would find an attorney and ask what the law is on the subject.

In a neighboring town if a house turned into an eyesore the owner was given warnings and if unheeded, the town stepped in and repaired the house. The cost of all of this was added onto the tax bill. If the homeowner could not pay the taxes the house was claimed by the town and sold for back taxes. This was probably not entirely legal, even though it was the local law. How many people who do not have enough money to pay taxes have enough for an attorney?

There are 'laws' that will not hold up in court with a good lawyer and funding to prosecute.

My 2 cents. Put a chain at the end of the driveway with a sign on it. Since the times in which this happens are well established, then your sister can put it up only at those times, reducing the annoyance to her.

If neighbors ask her about it, she can present it as a 'safety issue'. She is worried that some kid will get run over since so many people have been backing out in such a busy area.

Someone asked why people get upset over this. My old car was REAR-ENDED in my own driveway. Hit and run. I now have a new car. I don't want a RE-PLAY!!! Is that reason enough for you people who think it's no big deal? Good thing my old car wasn't a person or pet wasn't it?

It boggles my mind too how some people look at me with evil eyes whenever I have to back up on their driveway. Really?

But then again, that's why one of my big no nos when we're looking for a house is no house within a major road. I see no advantage AT ALL on a house sitting by a major road whatsoever.

I live on a wide street (where K-Turns are easily made) next to a baseball field where baseball games are played on a daily basis from April thru August. My driveway had become the unofficial U-Turn and Drop-Off point for the local baseball teams at least 5 to 10 times daily.

When I tried to tactfully ask people to please stop using my driveway as a U-Turn/Drop-Off point, I would then hear comments like: What's the big deal it's only a driveway, If you have a problem with my U-Turn call the police, You need to get a life, etc.

To avoid future confrontations I started to park my vehicle at the end of my driveway, and I would also place orange traffic cones at the end of the driveway when no one was at home to try and prevent the U-Turns. And believe it or not somebody still ran over the traffic cones to make a U-Turn when no one was home.
