I have a home warranty with HSA. I live in North Carolina. 11 months ago the dated water heater at my house started leaking from the bottom and I filed a claim with HSA. They covered the replacement and contracted Plumbing Company #1 to do the work. Plumbing Company #1 did the work including new water heater install, new expansion tank install and code upgrades for the fittings. 11 months later the brand new water heater is leaking from the bottom. I filed another claim with HSA and they contracted Plumbing Company #2 to come out and look. Plumbing Company #2 determined that the new heater was bad and needs replacement under the manufacturer's warranty. Plumbing Company #2 also said that various other work was never done by Plumbing Company #1 as claimed. Thus Plumbing Company #2 will have to do additional work beyond the main water heater replacement like installing a 'new' expansion tank as well as proper fittings to get me up to code.

HSA is not paying for all of this extra work as it turns out and the bill is up to me for some of it(350.00$). My problem is this...either Plumbing Company #1 is lying about the work they performed or Plumbing Company #2 is lying about the assessment of the current situation. So #2 is saying that #1 did a bad install and all the work needs to be performed again. Should HSA be concerned that their original contracted work supposedly wasn't performed as billed and reported? I am being told by Plumber #2 not to mention the bad install to HSA because they will deny the claim outright. But I would think HSA would care and have some recourse since the original work was performed under their auspices less than year ago. I am worried that if I open my mouth and bring this to HSA's attention then I am going to be stuck paying for everything especially if the manufacturer catches wind of the supposed improper installation by plumbing company #1 I feel that myself having to pay for work that was already supposed to be done in the previous claim to be wrong and that something is fishy here. Anybody with experience in similar matters? Thanks.

I would get a plumber #3 in to evaluate the situation. But I would not tell him what #1 & #2 told you. Then see who liar liar is. If there is a legitimate problem with #1's work then the insurance company needs to know and to rectify it. If #2 is working you over then tell him to hit the road.

Did you look at the work after the first repair to SEE if the expansion tank was new, and that fittings had been replaced? After 11 months you should still be able to tell.

You don't have to take anyone's word for this.

The general opinion is that looking for reasons to deny payment is the typical modus operandi of home warranty companies. One way or another you may end up paying out of pocket.

The home warranty company has a contract with you to repair your water heater, and the plumber is working for them. You don't pay the plumber directly. IMHO, the plumber needs to discuss any additional costs with the warranty company.

I would wonder what the REAL reason is that company # 2 doesn't want you to mention this.
