No no. What we're saying is the HOA generally has a say about what happens outside the house. And you know they don't own that. Our last one, for example, they stated clearly in the paperwork that they have access for any erosion issue in the yards (didn't have that on our property), and to check anything like security, a neighbor saying we had a tree growing into their yard, etc. etc. We never had anything like those instance but it was in the docs in case it came up with any of the residents in the community. HOA reps were allowed to go into the yard to check on things and you'd know this in case you came home and someone was in your yard. Never happened even to anyone I knew...but it was there in case it was needed.

So....ask them about the fence in your yard that the HOA might control. Who do they feel is the owner (which one of you and your neighbor, what percentage.). Hey, it might even say this in the documents you got when you purchased.
