I'm confused.

Just from what I've read here, it sounds like Westin requires 50% upfront for any upgrades, which is credited to you at closing. This is standard practice for most builders and is explained to you from the get-go.
What's the problem again?

Yup, that's exactly how it works.

In our contract, we are liable to lose the 50% deposit if we cancelled the contract. But we were fully aware of this. This financially secures the builder in the case the deal does not go through or if the buyer backs out due to seller contingency contract, which is what we had. The builders need to insure that they can continue paying for the land lease and recover cost of materials until the home is purchased. This
is common practice.

In my case, we could back out of the home purchase if we couldn't sell our existing home after 90 days of signing contract with Westin. This does not include refund of our options deposit. We knew this because it was written in our contract, and our sales agent explained it to us in detail. This was a big risk that we were fully aware of.

But, with that said, we delayed choosing our options by 2 months ...gave us a little more safety net.

yeah... i paid 2500 earnest money upfront.. then wrote a check of 50% upgrade at design center.. i dont know what sulla's problem is.. looks like she/he wants builder to build the house with his/her upgrade without paying any..

builder asks for 50% in case buyer suddenly doesnt want to buy and the house has upgrades nobody wants..

Indeed,....if only this person wasn't inadvertently slamming the very builder that they chose to buy from. That's pretty silly.

Here is our story


This is my second house i'm building NOT the first one. We sign the contract for 260,000 (inventory house) with upgrades. Sales Rep told us that we have an option make changes to the upgrade since house is still in building process. After few weeks,we went to design center and ask price listing before the selection so we don't run out of bugget. Person at the design center said she don't have prices listing contact the sales rep.

Sales rep told us to make selection now and once we get the prices back from the sales manager you can decide what option you want to keep.Apprantely my sales guy doesn;'t have the price listing either. Upgrade came out to be 20,000 dollors and we had to pay them 10K for upgrade upfront. Since 10K is a big chunk, we decided to reduce our upgrade option to 10,000 and pay 5K upfront. We remove all the stuff from the upgrade spreadsheet and gave to our sales rep. After few hours,our sales guy call me us and told that Sales manager don't want to accept new changes . He wants 10K for the changes we made first time. He gave me two option

1.Give 10K for the upgrade
2.Buy the house without any changes we made.

I gave him peace of my mind ..can't write anything here . Bottom line he lied to us to sign the contract and promise things which cannot be done. There were lots of things he promise and now he is backing out.

Take it easy, i'm not trying to slam anybody..I'm trying to laid down the issues we are having. Its seems like you have very close relation with westin homes
