My Grandmothers house has sat vacant for approximately 3 years. The executor of the property is unreachable. What can I do legally to possibly obtain this property. There is no paperwork that says the property was signed over to anyone. As a family member do I have any rights to this property?

Was there a probated will? You say executor so sounds like there was. Did she leave the house to you in the will?

The Owner is still alive in an assisted living facility. And the person I was told that is overseeing the house is IMPOSSIBLE TO get in touch with.

If your grandmother is still cognizant, get her to name a new executor. But, I'll warn you up front - nothing can be done with the house as long as she's in that nursing home, most likely - they'll have claim against it in the event she can no longer pay for her stay in that home. Even if you got it signed over to you, there's a 7 year "look-back" in place that they could go back with.

He is trying to be practical. The house has been vacant for 3 years. Nobody is using it.
But it probably has already deteriorated. Nobody knows if it was flooded. Even if not, it is probably covered with mold from the inside. I don't believe AC has been running all that time.

He has no rights to the house regardless of whether it's been vacant, flooded, moldy or whatnot.

So, let me understand this. it is wrong of me to inquire about a home where I grew up and have happy memories, to want to share this with my children. Rather than let it turn into an eye sore. But, I guess that is what is happening. How dare I want something that I and other family members put love and care into continue on instead of just falling down.

Lighten up, Francis! I think when you mention "executor", then mention that your grandmother is still alive, it makes you look bad.

But the point is, it isn't your house and apparently someone else was appointed as official caretaker of it. If you don't have a power of attorney, and she is still alive, there is nothing you can really do.

You have about as much right to that house as you do to mine. That would be zero...

Maybe make an offer to buy it, if you want it so badly...
