I'm interested in purchasing a home that has enough land to where I can build a kennel on the property (.25 acres or more). The interest is starting a home business that can possible transition to a good retirement options 20 years later. While doing some research about the ordinance for Harris county and a few cities I found restrictions on the number of Dogs/Cats a person can have on the property.

for example:
http://www.cityofhumble.org/New%20Or...%20-14-732.pdf

In the ordinances it states that a person can not have more than 4 dogs/cats that exceed the age of 3 months. It was very clear and straight forward.

Can someone educate me on why I see people in places like Spring, Humble, Tomball; (to name a few), that own and have horses, chickens and possibly some other types of animals on their property.

Why is this allowed, but owning Dogs/Cats is not allowed? I'm looking to start this business from my home to minimize the start up cost. However, after reading the ordinance, I am not sure how I will be able to do this. I am a little baffled over the fact that a person can own one breed of animal and house them on the property but not another.

Feedback and guidance is appreciated.

It is all contingent on where the property is.

Every incorporated city has their own rules. Most subdivisions have their own deed restrictions. Some subdivisions in the county have none. That's where you see horses. The CoH allows chickens, but they cannot be within x feet of the property line.

Unincorporated counties cannot make ordinances without special permission from the lege. Things such as dogs and cats must be on a leash.

Thanks Crone -
So I will surely have to examine the HOA rules before I decide to consider the property. I find that it is very had to find homes that are not a part of a Subdivision here. I come from the Mid west were there aren't as many subs.

Even if deed restrictions allow a home based business, operating a breeding or boarding kennel on a smallish subdivision lot may not go over well with your neighbors.

You can't compare livestock to dogs/cats.

Most HOA's (99%) of them do not allow a home business like you are discussing. Your neighbors would not like it either with dogs barking. There is an ordinace against that and rules in all HOA bylaws about nuisance barking.

You will have to look in unincorporated Harris County. Parts of Cypress, near Spring and other outlying areas you should be able to find a home with land that can accommodate this.

Check out areas like Cypress Gardens subdivision. There are fair sized yards, no deed restrictions and are not too far out. Older subdivisions like this are all over Harris county.
