Okay, so I have been in my apartment unit for 4 months now and my AC has been leaking for 3 months.
I have given the landlord 2 written notices about the leak and after the second notice they came to fix the issue but they left it the same.
I decided to certify my 3rd written notice and once the office received it they sent maintenance over to fix it once again, and again they failed to do so.
It's been a week since they received the letter and the leak continues. There is water all over the floor and under the flooring. I have a toddler who cannot go in the restroom because he falls from how slippery the floor is.
The maintenance guy told me that he will install a new AC unit but it won't be till Monday, so I still have to wait 4 days for the problem to get solved.
But at this point I don't want to wait anymore, I just want to get out of this place. They've had more than enough time to fix it and they haven't.
On my lease it says that if I send the written notices or certify a letter and they don't do anything about it, I can terminate my lease under Tex. Prop. Code 92.056.

Is it possible for me to still terminate my lease under Texas Property Code 92.056 without penalty?
Even though they've sent maintenance over and they made me sign my second written notice after the maintenance guy came in to "fix" the problem but the problem still contunies.

They tried their best to fix it, and now are going to replace the unit. Four days is not unreasonable wait. I don't think you have a cause.

Try your best to enjoy the holiday weekend and see if they replace it Monday. If they do not, then it may be time to explore other options.
