We had a photoshoot for our child. My spouse has signed an agreement. Who reads them, right?

The pictures came out great. We enjoyed working with the photographer. She was professional. However...

The photographer has printed the street banner with my child photo on it.
Did I give her permission? No.
Did she have to ask me for one? No. My spouse has signed an agreement, without reading. Artist's copyrights were stipulated in the agreement.

The end of story.

So please learn from my mistakes. And actually READ WHAT YOU SIGN.

Many families would probably change the agreement OR go to another photographer.
The IP law allows you to keep copyrights for what you pay.

Most people clicked "I agree" without reading anything to post on this forum.

Just let it go and be proud your kid is photogenic enough to sell photography.

I think you'll find that most photographer agreements keep the copyright with the photographer, not the client.

Look into getting paid for your child's photo being showcased on the banner.

Yes he owns copyright to his work, but your child and you as a parent own modeling rights. I am not sure how exactly the contract was written, but he is definitely abusing his photography rights. Maybe you have some power at least to remove those banners.

My guess is that your partner signed a standard release which gives the photographer unlimited rights to use the work for promotional purposes without any compensation to the model. The only time you have recourse is if the images are used in a defamatory way.

You might have unknowingly signed a contract stating that you and your child were actually working FOR the photographer. In that case the photographer owns all the rights.

Wrong! Maybe you and your spouse don't read before signing...but I would never sign any agreement for anything without reading it first.
