A weekend, not too long ago, we went to do some upkeep on a lot we have in 3rd Ward. Upon arrival we saw huge concrete slabs on it, across the street we saw where the city was pulling up the sidewalk and working on them. We took some pictures, worked around the concrete slabs and went home. I called to see what exactly was going on and when the concrete would be removed (crickets)... A week later I get a letter with a citation for heavy trash (out too early).

My first reaction was, WTF? I called the dept of neighborhoods and public service, they looked at the citation and the photos the official who gave out the citation uploaded and had the same reaction as me.

Eventually after talks with that department and the court and the neighborhoods dept again they sent a letter saying it was dismissed. Dismissed but it is still on my record thanks.

So I called again, because I want my record squeaky clean as it should be. Well looks like the citation is stuck on there, with notes as to it being dismissed and I guess the reason behind the dismissal, but still

The officer who gave the citation doesn't have common sense... Officials like this guy should be relieved of duty.

Now I have a record because of an error.

And the concrete slabs are still on the property.

This is more a rant but ...

It was dismissed, so you don't have a record. It's a civil penalty in any case, and has no effect on anything. If you look at court records for criminal cases, you can see lots of cases where the charges were dismissed, but the record remains. You are worrying about nothing.

That citation, even though dismissed, is a matter of public record. Unfortunately many more will not have common sense and if it is ever pulled, as small as it may seem, it might cause issues in some future endeavor. It is good that you are pushing to have it fully expunged from the records and I would continue to do so. There is nothing at all wrong with the desire to have a "squeaky clean" record. Never settle for less than "what should be" as that is a sign of just giving up and yielding to the stupidity out there.
