Why do so many large bankruptcies happen here? Are our bankruptcy courts known for being lenient?

Of course, the obvious tells you Texas state level politics and their “business friendly environment”. But we aren’t the only large bankruptcy court in Texas.

According to the Financial Times this is where they’re taking place (minimum $500M+ in liabilities) in 2020:

Houston, TX: 41
Wilmington, DE: 39
New York, NY: 9
Richmond, VA: 5
St. Louis, MO: 2

Houston has emerged as a favoured destination for companies seeking Chapter 11 protection, a feature of a US system that gives companies the liberty to file their case in virtually any federal bankruptcy venue they like.

Proponents argue that the system has fostered a group of expert jurists to sort out complicated corporate structures and messy claimant fights. Some scholars derisively label it “forum shopping”. Now, legislators are pursuing bills to halt the practice.
