My mother just recently got married last Oct. She recently started the process of buying an investment home in Houston TX, but she lives in Baltimore MD with her new husband. She ran into a situation in which the loan offer asked about her husband, because Texas is a Community Property State. She doesn't want her husband to have anything to do with her investment property (not have to sign anything) because she will be using her own money to purchase the property. What are her options?

It really depends on how she got the money to invest. If the bulk of the money is from inheritance or the sale of a property she had prior to the marriage - it can be outside the realm of "Community Property". However, if she can't prove that, she should visit with an attorney. Also, if she and her new husband were to move to the property, ie homestead it, it would revert back to Community Property even if she bought it with proceeds from inheritance etc.

The money to invest is from the sale of a property she had prior to the marriage. She and her new husband under no circumstance will live in the new investment property or even in the state of TX. She wants to take advantage of the buyers market here in TX and invest in property with out her husband.
