HOA's cannot foreclose for deed restriction violations, only for non-payment of monthly assessments, but they can turn you over to an attorney that will stack penalties on top of penalties on your account that will be payable upon transfer of ownership of your home.

Theoretically they could take you to court to get a civil court order to fix the deed restriction violation, which could end up with the homeowner being held in civil contempt of court.

We looked at Heritage Park back when it was just being built (the newer sections) in the 90's. We ended up buying an older place in Camino South, but we liked the neighborhood very much. That whole side of the freeway just seemed very empty and far from Clear Lake. Friendswood Link was a narrow 2-lane that turned into the end of El Dorado and all of that new area was empty fields like a big retention pond. It was our shortcut to 518. Now it's like a whole other world when I visit.

HOA communities can definitely have their pitfalls.. I would look to into voting in new fresh blood when the time comes. I think it is good to think outside of the box. The HOA that I used to live in back in Florida use to tell me my garbage can had to be in the garage. We had bears and I refused to put it in there because of the damage the bear could do to access the garage for sake of a little garbage. I now live in an optional HOA, they really do not mess with anyone but strive to maintain the aesthetics of the neighborhood. Sorry your experience has been lackluster...
