Much as I hate the metal thieves that steal for scrap metal, I gotta admit they are stupid. Had one come around today, I saw her on one of the security cams (motion alarmed) and toddled on up with one of my mowers as if I were just mowing. Found her out back in one of the old sheds with a pitiful bucket of a few bits of aluminum. What is funny is she had to pass two signs that said the area was under remote video surveillance 24/7. Guess she doesn't read too well. Gave her a stern look, listened to her apologies without comment, but it was hard to keep from bursting out laughing at her stupidity. She is just lucky she didn't try any B&E. "Home Alone" doesn't have half the tricks I do, and she would have had to be arrested on top of that.

OTOH, a big branch on our property fell into the street today, and rather than call the county, a neighbor dragged it to his place for firewood. I may even offer him more.

If she was on your property - trying to steal from your shed, won't the castle doctrine apply?

Or does she have to be trespassing inside the house before you can introduce her to your best buds Smith & Wesson?
Just wondering ...

Most of them that are stealing the metals are druggies so the brain is at least half fried. We have a distant relative in Vegas doing time for just that... she was stealing copper.

First, it would be a lightweight Taurus I carry, not an S&W. Second - Alabama law is VERY specific in that you HAVE to be in fear of your life AND have done everything possible to de-escalate a situation. If you have a CC and don't know that, you need to leave your weapon where you can't reach it and land yourself in jail. Third, if she were dead, how could she warn all her friends to stay away?

I have her car tag # and info. I have images of her on the property. I suspect she will avoid the place now that she has been edumacated. She made a really stupid mistake, one that really caused me no damage and may serve to make the place even more secure. Of the possible outcomes, I think that is about the best I could hope for and I have no need to get my gonads in an uproar over it.

Yeah, it was an interesting day.

Ahh, I am glad that Alabama of all places has such level headed Gun Laws regarding intruders and trespassers.

Sure makes that old man when I was a kid a lot less scary with his shotgun now...

We were just passing through his field, not stealing or vandalizing, just making our way through it in a non crop season.

Anyway I can't wait to get a gun!

Ah, Gunny.

I believe Texas is the only state in the union that allows one to legally shoot someone for the simple act of trespassing, at least that's what i have been told. Virtually all others will require something similar to "fear of harm or death" to allow justified use of lethal force. Now as far as "introducing" someone to Mr. Smith, Mr. Taurus, or a whole host of other distinguished gentlemen, burglary is a "forcible felony" and therefore may be met with the point of a gun (i. e. you can draw on someone who has entered your house illegally, and hold them at gunpoint), but that alone doesn't justify shooting. Mere property theft, trespassing (outside of Texas), and/or vandalism are NOT forcible felonies and do not warrant an armed response from a private citizen...so if one were to point a gun at a person on their property but outside a building that they suspect is intent on stealing, or even in the act of stealing, they will likely find themselves in need of a good defense attorney.

Pretty much. However... I use my property for target practice, and I may already have a weapon out. I wouldn't point it at someone casually, but then again, I'm not going to hide it behind my back either. The women on my property had a German Shepard with her. He was a sweety and no threat. However, if I HAD felt threatened and it hadn't been immediately addressed, she could have lost her dog.

The key on all of this is REASONABLE, and LEAST amount of force to effect what is needed. It isn't rocket science.
