Hi

This is me and my husband's first home purchase. We signed a purchase agreement, all parties have signed. We are a day away from closing and seller is trying to back out of the whole deal. We are going to be homeless come tomorrow so I have a back up plan for a rental, but I am wondering what rights I have. I have already consulted an attorney he advises me that she can't do this but I dont want to have to go through attorneys but she is giving us no choice. What should I do?

Stay away from an attorney. They will charge you hourly and may not get you a better result. You can handle this on your own in court. Not sure what Idaho real estate laws are but your realtor should be able to help.

Sorry to hear about your troubles. If you're up for doing your own research, this is probably the website to do it, Idaho Statutes Title 54, real estate law (scroll down to around 2060 and further): Idaho Statutes TITLE 54 PROFESSIONS, VOCATIONS, AND BUSINESSES

Melinda, sorry to hear about these difficulties. I would talk with an attorney, much as I dislike them in principle. You don't have a lot of time and need answers NOW. I would think that, if they insisit on backing out, you could recover any costs you incur. They have signed a contract after all. Find a lawyer with experience in realestate and contract law would be my recommendation. I would also think that you should be able to sue for any legal costs you incur. Were there any contingencies in the purchase offer that give either party the right to back out? I generally dislike lawyers and threats of lawsuits, but in this case it sounds justified.

if she has signed.. she can't back out unless any conditional options pre-noted in the contract have occured...
it's a contract and a matter of contractual law.. if all party's have signed she's up **** creek.. I would advise talking to your agent first before going to a lawyer..

Unfortunately, you may even just need someone to officially write a letter and tell them to get out or be sued. Sometimes that's all that it takes. Sometimes...

I believe people need attorney for two reasons. First you are in big trouble and second you are dealing with something very expensive. I think you fit both. Find an attorney.

I am sooo sorry to hear this. Its been a little while. Have you have any news?
I would have suggested you speak with your agent, their agent, the back doing the loan, the title company. ALL of them have some influence on the seller. But if all that did not work I would get the attorney and see if he/she would take the case and get payed at the close and make the seller pay the fees.
It can be done especially if they are clearly at fault. BUT not all attorneys will do it.
