Employers who hire illegal immigrants can be fined, but the Obama administration warned this week that they also can be fined for asking legal immigrants to show their green card before hiring them.
An I-9 is usually filled out AFTER a person is hired. To ask ANY person to fill it out PRIOR to hiring would be leaving the potential employer open to claims of discrimination.
The I-9 form asks specifically for documents from columns A (which includes passports, Green card)OR from B AND C (which includes DL and SS card). If I supply a document from A I am not supposed to be asked to provide documents from B or C (but I always am, and will argue the point). If you can supply Dl & SS card then they can't ask to see a GC as well (technically).
There's no REASON for a POTENTIAL employer to ask for any of these documents PRIOR to hire as they are legally covered -

Plenty of job ads do specify "must be authorised to work in the USA" however.
Job applications ask for social security number. When you're hired you have to produce it. And a legal immigrant should show proof of their immigration status prior to hiring them.
I don't give my SSN on online job apps. and as to the rest, see my post above yours. If a LEGAL immigrant is required to provide proof then so should EVERY applicant, including citizens.

I hardly think it is discriminating. An employer doesn't want to go through the whole interview process and hire someone only to find out later that they aren't authorized to work in this country. It is a waste of the employers time. It just makes sense to ask right up front IMO.

It should be assumed that a person has the right to work in the USA - the I-9 is to VERIFY that. It should also be assumed that the employee is AWARE they need to be legally able to work in this country. It's not rocket science.
Personally I think the whole "issue" is a storm in a teacup frankly.

I've filled out applications where I had to fill out the I-9 forms during the application process. of course yes I did have the option of providing the documents after I'd been hired.
