SALT LAKE CITY — The Utah House has approved an Arizona-style immigration enforcement law after heated debate.

Republican Rep. Stephen Sandstrom of Orem says House Bill 70 will discourage illegal immigrants from coming to Utah and reduce crime.

The bill passed on a 58-15 vote after more than an hour of debate Friday. It now goes to the Senate.

I hope they can make it work, in my work state of AZ ( I live in CA, work in AZ ), we are under the gun and on the national radar. Any progress that we make, is immediately undermined by the current administration. It seems we can't even sneeze with the Federal Gov getting in our face.

Utah's Law Enforcement Officers, as well as every other state's, can be "deputized" and act as a "immigration agent" with all the enforcement capabilities of a federal agent...today.

Under DHS/ICE's 287(g) program, local law enforcement agengies can partner with the "Feredral Gov" and enforce federal immigration law.

So, is a State law "all for show"?

Even under the proposed Arizona law, LEO would not act a state immigration officers, their main point of contact is on the road and in assistance calls. Which is already provided through the 287(g) program.

What of the cost of a state immigration law option? Under 287(g), DHS pays for implementation and training, but local communities pay all other costs. Not only would local communities incure the normal costs of policing, but under state mandated policies, local communites would incure the cost of training, housing, and litigation. What of the cost of duplication of services? Not only will the tax-payer of a participating state have to pay for federal immigration enforcement, they add state incured costs.

Every LEA whether they participate in 287(g) or not, are reimbursed by the federal government for housing aliens till hearings and deportation. Under a state immigration laws, would the federal government fund housing for state crimes/criminals? Is this another duplication of services[costs]; or is the state just using the law to apprehend/arrest suspected aliens, never intending to prosecute or try cases, but leaving it to ICE to ejudicate and deport?

I know, I happen to be one of those LEO's ( in AZ no less ). Here is the problem with getting everyone 287(g) certified.
Some departments don't want any of their Officers certified, some departrments only want some of them ( mine ) and some want everyone certified ( MCSO comes to mind ). Back when I worked Immigration/Border Crimes, a two week certification course was the norm, it was out of state ( in DC ) and there were very few agencies out here willing to send Officers for the training for that amount of time. the training may be/is probably different now, I don't know. We managed to circumvent this line of thinking by having one of those who were certified, in/or a part of every investigation we ran. It worked at the time, probably still does. The state law was far from all show, it may have been a victim of negative press more than anything else.

This here, is the major stumbling block. The sheer volume of UDA's would tax any agency out here if 1070 passed. As it stands now, ICE rarely comes out if you stop a load vehicle filled with UDA's. BP on the other hand, I've seen them run code 3 up into Phoenix from Casa Grand to pick up UDA's. I was hoping that we could enter into a contract to deport UDA's with the BP or ICE - or both ( I've heard rumors of that happening, nothing solid though ).

Right now, it's arrest, document and deport.

Good Insight.... I was not advocating or diparaging 287(g); only using it as a comparison of cost. On your last statment of "arrest, document, and deport" are you saying that local LEAs do the deportation or turn IAs over to BP/ICE for deportation?. How long of a typical wait is it between immigrations status comformation and deportation?

After arrest, they are booked into the county jail where 287(g) certified Deputies ( in Maricopa County ) question them, record their identities and go before a judge who pretty much explains why they are being sent back. After that, they are turned over to ICE or a security company ( G4S Wackenhut ) that is contracted out to transport them back over the border. Depending on how busy the jail is, it can go anywhere from a couple of days to weeks.

Wackenhut......is that the same one with armored trucks that transfer money to and from banks?

Ain't that the truth, i do feel sorry for those of you in Arizona, i have family who live there, who said that Arizona has been hit hard, and business not as it use to be, and for the most ignorant of reasons in my estimate. Sorry so many can't understand what your State is going thru.

Maybe we'd have better luck if we shipped the illegals to Obama's home State.
