Offence, in law, is a violation of the "criminal law (code)", EWI and remaining for a period of time of illegal aliens (Federal Misdemeanor). It is by no means an infraction which would be a summary hearing. A "civil offence" is a crime (Judge Brennen - Plyler vs. Doe) punishable with jail time (6 months or more) and/or a fine and a jury. Jaywalking is an infraction, not an offence, punishable with a jail time of less than 6 months and/or a fine with no jury. Since EWI has no jury during their hearing, it is now an Administrative case which is the Federal Government prosecuting the individual. An illegal aliens deportation hearing takes place before an Immigration Judge. Since the penalty is deportation and/or a fine and/or jail time of 6 months or more (civil and criminal penalties), many people think of the immigration court as a civil court. In fact, the immigration court is a criminal court, as it is the government prosecuting the offense.

Well the white house needs to put a spin on it. Our president had not 1 but 2 familiy members caught here illegally and both caught breaking more laws than simply being here illegally. What are the odds of that?????
So now we need to put a spin on it to also appease a very disgruntled hispanic base who feel that Obama has yet to live up to his promises of immigration reform. A reform any could call amnesty and it would fit.

Is it common sense to allow someone who beat up his wife to go free because we have to prioritize those who have murdered their wives instead? The problem is that Obama and the DHS will never deport those people so it isn't about prioritizing but granting them amensty and to top it all off they are going to get work permits even though millions of Americans are out of work. How many more illegal aliens will come forward without being "convicted" of a serious crime and be granted the same thing?
Sorry, but our immigration laws don't prioritize deportations. Anyone here in our country illegally is supposed to be deported according to our laws.

That is our problem, too many damn people making excuses why it is acceptable for them to break our laws, pretty clear now. The whole lot of this administration just needs to plain go go now.

You are of course assuming that, that is where the criminal activity ends. The reality is that this is only the begining. But then you know this. ID theft and or fraud, tax fraud or evasion and many more that have been discussed at length.
The excuse that if we simply legalized them doesnt wash. That is unless we opt to parden everyone who commits these same crimes but for different reasons. Is that what you would recommend?
